1. Operator and scope
These terms describe permitted use of the Digital Fabrication LLC website and our general approach to business engagements. Digital Fabrication LLC is a Missouri limited liability company, charter number LC014634537, located at 3827 King Hill Ave, Saint Joseph, MO 64504-1017, United States. Contact: support@digitalfabrication.online. A signed service agreement or accepted written statement of work governs any purchased services and takes precedence over this general website information if there is a conflict.
2. Inquiries and formation of an agreement
You may use this site to learn about our services and submit an inquiry. Sending a message does not create a contract, reserve project capacity or authorize a charge. Before paid work begins, the parties must agree in writing on the scope, deliverables, fees, payment schedule, revisions, timeline and any project-specific conditions. You must have authority to engage us on behalf of the business you represent.
3. Services and exclusions
Our work may include website design, information architecture, UX/UI design, SaaS or app interfaces, prototypes, component systems and design documentation. Coding, deployment, domain registration, hosting, maintenance, copywriting, paid assets and third-party subscriptions are not included unless stated in the agreed scope. A visual prototype is not a production software application.
4. Client responsibilities
Clients are responsible for providing accurate requirements, timely feedback and materials they are entitled to use. Clients must identify relevant business, accessibility, regulatory, security and technical requirements before scope is agreed. The client remains responsible for business claims, product information, legal content and final approvals. Delayed materials or feedback may require the schedule to be revised by agreement.
5. Fees and payment
Fees are quoted for each project in writing. Currency, applicable taxes, deposits, milestones and due dates are specified in the proposal or service agreement. This website does not collect card payments or sell a subscription. Additional expenses or third-party purchases require prior agreement. No recurring charge arises merely from visiting the site or submitting the contact form.
6. Revisions and scope changes
The included revision rounds and acceptance procedure are defined in the project agreement. New features, additional screens, a changed design direction after approval or other out-of-scope requests may require a written change order with revised pricing and timing. Neither party should assume a requested change is included until it is agreed.
7. Timing and delivery
Project schedules depend on the agreed scope, approvals and availability of necessary materials. Any target date is confirmed in the written agreement. Delivery formats and handoff materials are identified before work begins. Third-party services and client development schedules may affect implementation after the design handoff.
8. Intellectual property
Each party keeps its pre-existing materials, methods and intellectual property. Rights in final deliverables, editable source files, reusable components and third-party assets must be set out in the project agreement; no transfer is implied merely by viewing a proposal or prototype. Any assignment or license may be conditional on full payment as agreed. Clients must hold appropriate licenses for materials they supply. Portfolio use of confidential or client-identifying work requires permission.
9. Confidentiality
The parties should identify confidential materials and agree appropriate confidentiality obligations before disclosure. We use project information to evaluate or perform the engagement. Do not submit trade secrets, credentials or sensitive regulated data through the public inquiry form. A separate nondisclosure agreement can be agreed when needed.
10. Cancellation, refunds and suspension
The project agreement sets the cancellation process, treatment of completed work, deposits, committed expenses and any refundable unused balance. There is no blanket nonrefundable policy created by this website. If either party needs to end or pause an engagement, it should give written notice so the parties can determine the work completed and amounts due under their agreement and applicable law.
11. Outcomes and limitations
Design recommendations are based on the agreed brief and available information. We do not promise a specific level of revenue, conversion, funding, search ranking or commercial success. Website information is supplied for general reference, and uninterrupted or error-free availability is not guaranteed. Any project warranties, liability allocation and remedies must be stated in the service agreement and remain subject to applicable law. Nothing on this website excludes rights or liability that cannot lawfully be excluded.
12. Acceptable use
Do not submit unlawful content, impersonate another person, send spam, attempt unauthorized access, interfere with site operation or infringe intellectual property. We may limit abusive submissions to protect the service. You are responsible for the accuracy and lawfulness of information you submit.
13. Privacy and third parties
Our Privacy Policy describes processing of website inquiries and technical information. External tools, platforms, assets or services used in a project may carry separate terms and licenses. Their costs, selection and responsibility for administration should be agreed in the project scope.
14. Governing law and concerns
Subject to applicable mandatory law and any signed project agreement, these website terms are governed by the laws of Missouri and applicable United States federal law. Contact us first at support@digitalfabrication.online so we can try to resolve a concern in good faith. Nothing here imposes mandatory arbitration or waives nonwaivable statutory rights.
15. Changes and contact
